Expected checks

Standard practice, or implied by a provider's enrollment duties; no rule names them outright

None for this program.

Also required

Not registry lookups; ezOIG doesn't run these
  • Documentation of competency (SFN 749) signed by a licensed professional for each direct-service employee before services, valid five years, unless the employee holds a current ND CNA, LPN or RN or the agency is a DD-licensed provider (QSP Agency Handbook; NDAC 75-03-23-07(6), (7))
  • No conviction for a direct-bearing offense, and notice to HHS within five business days of a change in an owner's or employee's conviction history (NDAC 75-03-23-07(2)(b); QSP Agency Handbook)
  • No fingerprint check: the HCBS waiver says criminal background checks are completed only for adult foster care and respite in an adult foster care home (ND.0273 waiver, Appendix C-2-a)

Why some registries are not screened yet

The registry blocks automated access
The registry's website turns away automated lookups. We don't work around that, so for now your staff search it themselves.
The registry's terms forbid automated searches
The registry's terms, or the law behind it, rule out automated or third-party searches, so ezOIG doesn't run them.

Guidance, not legal advice

This page summarizes ezOIG's research into North Dakota's rules for this program, checked against the regulations as of October 16, 2026. Rules change, and an agency's own contract or license can add to them. Confirm what applies to you with North Dakota Department of Health and Human Services, Medical Services Division (ND Medicaid); HHS Aging Services and the Developmental Disabilities Section run the HCBS waivers or your own counsel before relying on it.
