Expected checks

Standard practice, or implied by a provider's enrollment duties; no rule names them outright

None for this program.

Also required

Not registry lookups; ezOIG doesn't run these
  • Fingerprint-based state and nationwide (FBI) check: for a foster home for adults, of anyone employed by or providing care in the home and adults living there, unless they have lived in North Dakota continuously for eleven years or since age 18 (NDCC 50-11-02.4(2), 50-11-06.8(10)); for an agency foster home for adults, NDAC 75-03-21.1-36(4) requires one on everyone employed by, providing care in or living in the home, while the AFHA Handbook asks for prints only after out-of-state residence in the last 11 years
  • No direct-bearing conviction (NDAC 75-03-21-09.1, 75-03-21.1-36)
  • Agency foster home employees: department-approved medication administration, traumatic brain injury and dementia training (NDAC 75-03-21.1-29(1)(f))

Why some registries are not screened yet

The registry blocks automated access
The registry's website turns away automated lookups. We don't work around that, so for now your staff search it themselves.
The registry's terms forbid automated searches
The registry's terms, or the law behind it, rule out automated or third-party searches, so ezOIG doesn't run them.
Checked by request to the agency
The agency answers a written request or form rather than an online search.

Guidance, not legal advice

This page summarizes ezOIG's research into North Dakota's rules for this program, checked against the regulations as of October 16, 2026. Rules change, and an agency's own contract or license can add to them. Confirm what applies to you with North Dakota Department of Health and Human Services, Medical Services Division (ND Medicaid); HHS Aging Services and the Developmental Disabilities Section run the HCBS waivers or your own counsel before relying on it.
