Last updated: October 15, 2026
1. Acceptance of Terms
By accessing and using the OIG compliance platform provided by ezOIG LLC ("ezOIG," "we," or "us") (the "Service"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.
2. Description of Service
ezOIG provides an online platform for healthcare compliance management, including OIG exclusion list screening, Massachusetts registry screening, staff verification, document management, and related compliance tools. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.
3. User Accounts
3.1 Account Creation
To use our Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials.
3.2 Account Responsibilities
You agree to:
- Provide accurate and current information
- Maintain the security of your account
- Notify us immediately of any unauthorized access
- Be responsible for all activities under your account
- Not share your account with others
4. Acceptable Use
You agree NOT to:
- Use the Service for any illegal purpose or in violation of any laws
- Interfere with or disrupt the Service or servers
- Attempt to gain unauthorized access to any part of the Service
- Use automated systems to access the Service without permission
- Transmit viruses, malware, or other harmful code
- Violate the privacy rights of others
- Resell or redistribute the Service without authorization
5. Pricing and Payment
5.1 Fees
The Service is sold as a flat-rate subscription, billed monthly or annually, in which each plan includes a stated number of persons screened per calendar month. A person counts once in a calendar month if any check of any type is run on them in that month; re-checks of the same person in that month are not counted again. Current pricing and each plan's monthly limit are available on our pricing page. We reserve the right to modify pricing with 30 days' notice to existing customers.
Checks that carry a fee charged by a government registry, such as Massachusetts CORI requests, are billed per check at the registry's fee plus our service fee, as stated on the pricing page, and are not included in the flat rate.
When your organization reaches its plan's monthly limit, checks on persons not yet screened in that month are held until the next calendar month begins or until you move to a plan with a higher limit, whichever comes first. Checks on persons already screened in that month continue to run. Held checks are not lost and no additional fee is charged for them.
5.2 Payment Terms
- Payment is due as specified in your plan
- You authorize us to charge your payment method
- All fees are non-refundable unless otherwise stated
- You are responsible for all taxes and fees
5.3 Free Trial and Automatic Renewal
Paid plans may begin with a free trial period, which requires a valid payment method. The length of the trial is shown when you sign up. Unless you cancel before the trial ends, your payment method will be charged the fee for your plan when the trial ends. Your subscription then renews automatically at the end of each monthly or annual billing period, and your payment method is charged the price then in effect, until you cancel.
You can cancel at any time from the Billing page. Cancellation takes effect at the end of the current billing period, and you keep access to the Service until then. A change to a plan with a higher price takes effect immediately and is prorated. A change to a plan with a lower price takes effect at the start of your next billing period; until then your current plan, its price and its monthly limit continue to apply.
5.4 Failed Payments
If payment fails, we may suspend or terminate your access to the Service until payment is received.
6. Data and Privacy
Your use of the Service is governed by our Privacy Policy. You retain ownership of any data you submit to the Service. You grant us a license to use, store, and process your data solely to provide the Service.
7. Compliance Verification
7.1 Service Limitations
While we strive for accuracy, ezOIG does not guarantee that OIG exclusion checks or other compliance screenings are error-free or complete. The Service is a tool to assist with compliance but does not replace your obligation to maintain compliance.
7.2 Your Responsibility
You are solely responsible for:
- Verifying the accuracy of screening results
- Maintaining compliance with all applicable laws and regulations
- Taking appropriate action based on screening results
- Consulting with legal counsel regarding compliance matters
7.3 Massachusetts Registry Information (SORI and CORI)
Sex offender registry information (SORI) and criminal offender record information (CORI) are governed by Massachusetts law and regulations that limit who may request them and how they may be used. When you request a SORI or CORI check through the Service, you agree that you:
- Are legally entitled to request the information and have a lawful purpose for doing so
- Have obtained, and will keep, every consent, acknowledgement and identity verification the law requires, including a signed CORI Acknowledgement Form for each CORI subject
- Will use the results only as the law permits, and never to harass, intimidate or discriminate unlawfully against anyone
- Will meet any legal obligations that apply before you make an adverse decision based on the results, such as giving the subject a copy of the record
- Will comply with the terms of the registry account used to submit your requests
ezOIG submits requests on your behalf and relays the registry's response. It does not verify a subject's identity or interpret results. A "no match" result means only that the registry returned no record from the information it makes available; for example, the ESORI portal returns only Level 2 and Level 3 offenders.
8. Intellectual Property
All content, features, and functionality of the Service are owned by ezOIG and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express permission.
9. Confidentiality
Both parties agree to keep confidential any proprietary information received from the other party, except as required by law or with prior written consent.
10. Termination
10.1 Termination by You
You may terminate your account at any time through your account settings or by contacting support.
10.2 Termination by Us
We may suspend or terminate your account if you:
- Violate these Terms
- Fail to pay fees when due
- Engage in fraudulent or illegal activities
- Pose a security risk to the Service
10.3 Effect of Termination
Upon termination, your access to the Service will cease. You may request a copy of your data within 30 days of termination.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ezOIG SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
13. Indemnification
You agree to indemnify and hold harmless ezOIG from any claims, damages, losses, liabilities, and expenses arising from your use of the Service or violation of these Terms.
14. Governing Law
These Terms are governed by the laws of the State of Tennessee, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in the State of Tennessee.
15. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
16. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and ezOIG regarding the Service.
