    WHEN
AT HIRE Before hire; provisional employment up to 60 days pending the result

    K.S.A. 65-5117(e); K.A.R. 28-51-104(d)(2)(B)

Expected checks

Standard practice, or implied by a provider's enrollment duties; no rule names them outright
  1. List of Excluded Individuals/Entities

    HHS Office of Inspector General

SCREENED BY EZOIG Federal exclusion check against the HHS-OIG list
    WHEN
MONTHLY Before hire and monthly (agencies enrolled in KMAP)
    BASIS
KMAP's monthly screening duty binds agencies enrolled in KMAP; much supportive care is private pay; 42 CFR 1001.1901 bars Medicaid payment for services by excluded people; KDADS's Criminal Record Check Instructions also have the employer attest, when paying for each check, that it searched the OIG exclusion database

The effect of this exclusion is the prohibition of any payment for any items or services furnished, ordered, or prescribed by an excluded individual or entity. Compliance with federal regulation guidance requires both individuals and entities be screened on a monthly basis.

  2. Kansas Nurse Aide Registry

Kansas Department for Aging and Disability Services, Health Occupations Credentialing

NOT SCREENED YET The registry blocks automated access
    WHEN
AT HIRE Before hire, with the KDADS criminal record check
    BASIS
K.S.A. 65-5117(b)(1) bars anyone with adverse findings on a state registry; KDADS's criminal record check system checks the Kansas Nurse Aide Registry for abuse, neglect or exploitation findings on every new applicant

For any new applicant, the system will automatically check the Kansas Nurse Aide Registry (KNAR) for any prohibitions, including Adult Abuse, Neglect, or Exploitation (ANE) findings and criminal convictions, when using the “Request Existing Individual” option.

  3. Adult Abuse, Neglect and Exploitation Central Registry

Kansas Department for Children and Families, Prevention and Protection Services

NOT SCREENED YET Checked by request to the agency
    WHEN
    AT HIRE Before hire
    BASIS
K.S.A. 65-5117(b)(1) bars anyone with adverse findings on any state or national registry; the KDADS rules meant to define those registries were not found, and DCF's adult registry is the state's adult abuse registry

No person shall knowingly operate a home health agency if, for the home health agency, there works any person who has adverse findings on any state or national registry, as defined in rules and regulations adopted by the secretary for aging and disability services

  4. National Sex Offender Public Website

    U.S. Department of Justice

NOT SCREENED YET The registry's terms forbid automated searches
    WHEN
AT HIRE Before hire, with the KDADS criminal record check
    BASIS
KDADS Criminal Record Check Instructions: paying the CRC fee attests that the employer checked the OIG exclusion database and the National Sex Offender Public Website; no rule names NSOPW for this program

BY PAYING THE FEES YOU AGREE THAT YOU HAVE CHECKED THE OFFICE OF INSPECTOR GENERAL EXCLUSION DATABASE AND NATIONAL SEX OFFENDER PUBLIC WEBSITE AND CONFIRMED THE SELECTED INDIVIDUAL IS NOT PROHIBITED.

Also required

Not registry lookups; ezOIG doesn't run these
  • Reference checks, health history and assessment, and two-step tuberculosis skin test before working with clients (K.A.R. 28-51-103(d)(5), (6))
  • Personnel records holding evidence of a background check clearance (K.A.R. 28-51-104(d)(2)(B))

Why some registries are not screened yet

The registry blocks automated access
The registry's website turns away automated lookups. We don't work around that, so for now your staff search it themselves.
The registry's terms forbid automated searches
The registry's terms, or the law behind it, rule out automated or third-party searches, so ezOIG doesn't run them.
Requires an employer account
Searches go through the employer's own account with the agency, so ezOIG doesn't run them for you.
Checked by request to the agency
The agency answers a written request or form rather than an online search.

Guidance, not legal advice

This page summarizes ezOIG's research into Kansas's rules for this program, checked against the regulations as of October 16, 2026. Rules change, and an agency's own contract or license can add to them. Confirm what applies to you with Kansas Department of Health and Environment, Division of Health Care Finance (KanCare / Kansas Medical Assistance Program); the Kansas Department for Aging and Disability Services runs the HCBS waivers or your own counsel before relying on it.
