    WHEN

No South Dakota rule or SD Medicaid manual names it for hospices; 42 CFR 1001.1901 bars payment for services by an excluded person, CMS SMDL #09-001 asks for monthly checks, and SD Medicaid Provider Agreement 3.1 (May 2023) § 2.d requires notice within ten days if an employee becomes excluded

Provider agrees to notify Medical Services by certified mail within ten (10) days should the Provider or any of its owners, employees, agents, contractors, or any person or entity with any ownership or controlling interest become debarred, suspended, proposed for debarment, declared ineligible, or voluntarily or otherwise excluded from participating in Medicare or another state Medicaid program

    WHEN
AT HIRE Within three months of hire, employees with direct patient contact or access to patient records
    BASIS
One way to meet 42 CFR 418.114(d) for South Dakota court records; no South Dakota rule sets a hospice method, so the rule asks for checks in every state lived or worked in during the past 3 years. Criminal background checks must be obtained in accordance with State requirements. In the absence of State requirements, criminal background checks must be obtained within three months of the date of employment for all states that the individual has lived or worked in the past 3 years.

Also required

Not registry lookups; ezOIG doesn't run these
  • Criminal background check on employees with direct patient contact or access to records, within three months of hire, covering every state lived or worked in during the past 3 years (42 CFR 418.114(d))
  • Hospice aide training and competency (42 CFR 418.76)
  • TB screening of personnel in licensed inpatient and residential hospice facilities (ARSD 44:79:04:06, 44:80:04:06)

Why some registries are not screened yet

The registry blocks automated access
The registry's website turns away automated lookups. We don't work around that, so for now your staff search it themselves.
The registry's terms forbid automated searches
The registry's terms, or the law behind it, rule out automated or third-party searches, so ezOIG doesn't run them.
Paid access
The agency charges for access, and ezOIG doesn't include it yet.

Guidance, not legal advice

This page summarizes ezOIG's research into South Dakota's rules for this program, checked against the regulations as of October 16, 2026. Rules change, and an agency's own contract or license can add to them. Confirm what applies to you with South Dakota Department of Social Services, Division of Medical Services (HCBS waivers operated by the Department of Human Services) or your own counsel before relying on it.
