Expected checks

Standard practice, or implied by a provider's enrollment duties; no rule names them outright
  1. National Sex Offender Public Website

    U.S. Department of Justice

NOT SCREENED YET The registry's terms forbid automated searches
    WHEN
AT HIRE Before hire, for anyone who lived outside Georgia in the previous two years
    BASIS
111-8-12-.04(1) requires registry checks in every state lived in during the previous two years; NSOPW searches the other states' sex offender registries in one place

Also required

Not registry lookups; ezOIG doesn't run these
  • Fingerprint-based GCIC and FBI check through DCH's GCHEXS for owners, administrators, onsite managers, directors and direct access employees before hire or placement; a pending check allows up to 30 days of supervised direct access, never for administrators, directors or onsite managers (Ga. Comp. R. & Regs. 111-8-12-.05, -.06)
  • Medicaid waiver providers screen each potential employee through GCHEXS and bar anyone convicted of abuse, neglect, mistreatment or financial exploitation from direct care (EDWP General Services Manual § 605.1.15.2; ICWP Manual)
  • Nurses, physicians, pharmacists and dentists licensed in Georgia are outside the fingerprint requirement once their licence is verified in good standing (111-8-12-.03(8); DCH LTC Background Checks FAQ)
  • Registry checks (nurse aide and sex offender registries) in each other state lived in during the previous two years (111-8-12-.04(1))
  • Five-year employment history, TB screening at hire and yearly, and bonding for staff handling clients' funds (111-8-65-.09(4)(c))
  • Personal support aides: nurse aide certification, an approved competency examination or 40 hours of training (EDWP Personal Support Services Manual § 1408.3.1.2)

Why some registries are not screened yet

The registry blocks automated access
The registry's website turns away automated lookups. We don't work around that, so for now your staff search it themselves.
The registry's terms forbid automated searches
The registry's terms, or the law behind it, rule out automated or third-party searches, so ezOIG doesn't run them.

Guidance, not legal advice

This page summarizes ezOIG's research into Georgia's rules for this program, checked against the regulations as of October 16, 2026. Rules change, and an agency's own contract or license can add to them. Confirm what applies to you with Georgia Department of Community Health (DCH), Division of Medical Assistance Plans or your own counsel before relying on it.
